Public Register of Contaminated Land

 

Section 78R of the Environmental Protection Act 1990 as amended by the Environment Act 1995 (Part IIA), requires each enforcing authority to keep a Public Register of ‘Contaminated Land within its boundary.

The statutory requirements for the contents of the public register are set out in sections 78R(1) of the EPA 1990, and Regulation 15 and Schedule 3 of the Contaminated Land (England) Regulations 2000 (SI227/2000). Paragraphs 71 to 92 of Annex 4 of DEFRA Circular 01/2006 also provide guidance on the information to be placed on the register.

Sections 78S and 78T of the EPA 1990 preclude certain information from appearing on the Public Register on the grounds of National Security or commercial confidentiality.
